Article 1: Legal structure

1.1 Identification: This document sets out the conditions under which the services of the Riwil software ("the Service") are made available to end customers through our partners. The Service is published by LUCKY BOYS, a French simplified joint-stock company (SAS) with a capital of 3 000 €, registered with the Trade and Companies Register (RCS) of Bergerac under number 991 028 952, whose registered office is located at 165 Route de Villereal, 24560 Sainte-Radegonde, France (see the Legal Notice). Contact: marion@riwil.co.

1.2 Partners: Riwil's partners include, but are not limited to, restaurants, leisure venues, cinemas, and bakeries.

1.3 Definitions:

  • Partner: Any business entity that uses Riwil to offer promotional games to its customers.
  • Participant: Any end customer using the Service to take part in games at a Partner.
  • Game: A promotional activity consisting of leaving a review, following social media accounts, and spinning a mystery wheel to win prizes.

Article 2: How to take part in the games

The Participant may access the Game by scanning a QR Code provided by a Riwil Partner. The Participant may be invited to leave a review or to follow the Partner's social media accounts. These actions are optional and do not affect the chances of winning. Participation is validated electronically through the Service.

Article 3: Prizes

Prizes are provided by the Partner organizing the Game, who may choose to include offers from local or national third parties. The Partner is solely responsible for the choice of prizes, putting them into play, the probabilities of winning, the time limit for claiming a prize and its deliverability.

Article 4: Selection of winners

Winners are determined by the Game's system, managed by the Partner. They receive a gift coupon by email or SMS. The probabilities of winning are set by the Partner and must be disclosed transparently to Participants upon request.

Article 5: Conditions of participation

Any attempt to alter or influence the operation of the Game is strictly prohibited. Participants may play only once per establishment, unless the establishment states otherwise. Riwil reserves the right to verify the authenticity of entries and to take legal action in the event of fraud.

Article 6: Prize delivery

The coupon received by email or SMS must be presented to the Partner to claim the prize. The Partner is responsible for managing coupons and must inform Riwil when a coupon is redeemed via its back office.

Article 7: Intellectual property

Riwil holds all intellectual property rights relating to its platform. Any unauthorized use of the Service, including reproduction, modification or distribution, is strictly prohibited.

Article 8: Personal data (GDPR)

8.1 Data controller
Personal data collected in connection with the Game is processed by the Partner organizing the Game, acting as data controller. LUCKY BOYS SAS (Riwil) acts as a technical data processor.

8.2 Data collected
The data that may be collected is:
— email address
— phone number (optional)

8.3 Purposes of processing
The data is collected for:
— managing participation in the Game
— awarding the prizes
— sending the winnings

8.4 Legal basis
— Performance of the Game (contractual)
— Consent for any commercial marketing

8.5 Consent
The Participant is informed that:
— taking part in the Game is not conditional on accepting commercial communications
— any use of the data for marketing purposes is subject to explicit consent (checkbox)

8.6 Data recipients
The data is accessible only:
— to the organizing Partner
— to Riwil (technical service provider) and its processors listed in the Privacy Policy

8.7 Retention period
The data is retained for a maximum of 2 years from collection.

8.8 Users' rights
In accordance with the GDPR, the Participant has the following rights:
— right of access
— right to rectification
— right to erasure
— right to restriction of processing
— right to object
— right to data portability

They may exercise their rights with the organizing Partner (data controller) or by contacting: marion@riwil.co
The Participant may also lodge a complaint with the CNIL.

Article 9: Governing law and jurisdiction

These rules are governed by French law. Any complaint may be sent to marion@riwil.co with a view to an amicable resolution. Failing that, the dispute will be brought before the competent French courts, determined in accordance with the applicable rules, including, for consumer Participants, those of the French Consumer Code.
